(FP.ESS ASSOCIATION" TELEGRAM.) WELLINGTON. March 26. Tho Appeal Court sat this morning to hear argument in the case, Pitcaithley and Co. v. McLean and Son, en appeal from the decision of Sir Ilobert Stout upon a special case arising out of a claim by appellants for £20,000 damages for a breach of sub-contract under which the appellants undertook to ipply gravel and sand to respondents for the Wellington Dock contract.' Sir Kobert Stout held that under the sub-contract the respondents were only bound to order what material they required for their purposes. Appeilants held that this was not the correct interpretation, but that the respondents had to take all the gravel-and san'l provided for in the specifications. Mr Bell, K.C., Sir John K.C., and Mr D. Smith appeared for the appellants, and Messrs Morrison and Blair for the respondents. The argument is expected to occupy the greater part of to-morrow.
