In each case informant sues for a penalty of £100. Defendant is called upon to appear at the Magistrate's Court on Friday. The tramp steamer Neptune called at Wellington for bunker coal on the 3rd March last, while on a voyage from Port Kemhla to Falmouth with grain. She remained at anchor in the Btream off Kaiwarra till the morning of th© ■ Bth insW and then proceeded to England. It is alleged that during* her stay in port the paint mentioned was transferred from the steamer to a boat, and thence conveyed to Eastbourne.
