SUPREME COURT.

* IN BANCO. (Before his Honour Mr Justice Sim.) A PATERNITY CASE. An appeal by Ernest Tilley against the decision of Air V. v. Day, S.M., adjudging him the father of the illegitimate child of Annie Alarsden, was heard. Mr Donnelly appeared for the appellant, anel Mr Acland for the respondent. Tho case was originally brought Before Mr H. W. Bishop. S.M., who dismissed it without prejudice. It was afterwards brought before Mr Day, in Ashburton, anel an order was made against the appellant. The appeal before his Honour was by way of re-hearing, and evidence of both parties anel witnesses was hoard. Mr Donnelly submitted that the respondent had not given clear and convincing evidence, and that her own aelmissions as to her life shoulel disqualify her from obtaining an order. Mr Acland contended that there was ample evidence to support the finding of the magistrate who made the order. His Honour upheld the rinding of the magistrate. The story of the respondent as to her relations with the appellant was admitted by the appellant, and the only conclusion possible was that ho was the father of the child. The appeal was dismissed, and the order made confirmed. Costs were allowed the respondent.
