RACING APPEAL.
The appeal of Mr W. C. Harrison, owner of Kous, ngainet the decision of the Otago Metropolitan Committee, reversing tbe decision of the Winton Jockey Club, in connection with the protest by Mr Harrison against Jjoftus, winner of tha "Flying Handicap for running inside a. Bag, was heard by the Rao ins . Conference yesterday. The judges were— 3ir George Clifford. Bart., and Messrs F. H. Pyno and George Palmer. Their judgment is as follows:—Wo are unanimously of opinion that the decision of the Otago Metropolitan in thia matter must be upheld. They have properly decided that the question of whether Loftus went inside a post was not a matter of fact, inasmuch as the Winton stewards do not allege that they said the horse did do so; they treated the question as one of' evidence whether certain footprints were made by Loftus or by another horse in another race, which would certainly be a matter ci opinion. The matter is therefore open to appeal. On the point as to whether Loftus should bo disqualified for going inside a post we decide that there is not sufficient evidence to show that he did so. and therefore dismiss the appeal. We order the deposit to be refunded to the appellant.
