A CHARGE OF ASSAULT.
• CASE DISMISSED.
2kt the Magistrate's Court yesterday, beforo Mi V. G Day, S.M , Arthur William Heneley charged a young man named Dooley with assaulting him. Mr Donnelly appeared for the accused, and complainant conducted his own caee.
Honsley stated that he went home recently and found Dooley sitting in his house. Hβ ordered him off tne pre"miGes, and Dooloy etruck him in the face. He informed Sergeant Barrett of the occurrence, and when he saw the state hie face was in he advised him to go to the Court. ■Mr Donnelly: You have not told all tho story. Witness: Dooley, with his aliases, was using a chair. I did not take my coat off. When I was hit I picked tip n shovel. It is a pity I did not scalp him outright. Mr ' Donnelly: You did get round him with tho shpvelP Witness: It's a pity I did not get further. Only for the chair he would have got the Denefit of the ehovel. Complainant's eon gave evidence as to Dooley starting the trouble. Dooley, whom the Magistrate •* advised to drop his incognito, said that his name was Frank Willinm Howell. "I was in the house when Black CharHe, the plaintiff, came along, find eo'id he did not want burglars in his house. Ho took off his coat, and then picked up the ehovel and went to hit mc, end I grabbed the chair in order to defend myself. Hβ threw the shovel, and it got mc just over the eye." The Magistrate: Have you any question to nek the defendant P Hensley, after cross-examining the witness, remarked: "It'e absolutely no good. He has a solicitor; I hnve none. He hae no witnesses, and I hare one." The Magistrate: Case dismissed.
