DRAINAGE BOARD. LOCAL BILL. IN THE MATTER of a proposed Bill or Act. intituled "THE CHRISTCHUKCH DISTRICT DRAINAGE ACT, 1875 AMENDMENT ACT, 1606" (No. 2). TJURSUANT to the provisions of the Stand--t ing Orders of the House of Representatives relating to Local Bills: the Inhabitant!) of the Avou Road District, the Inhabitants of the Hcathcote Hoad District, the Inhabitants of the Spreydon Road District, the Inhabitants of the Riccarton Road District, the Mayor. Councillor*, and Burgesses of the Boroueh of New Brighton, and the Mayor, Councillor*, and of the Borough of "Woolston, hereby give notice that application will be made to the General Assembly of New Zealand in Parliament assembled at the Session to commence on the 21st day of August. 100G, for leave to introduce a Bill, to be called "The Christchurch District Drainage Act 1875, Amendment Act. 19C6" (No. 2). The object? of the said proposed Bill arc: — To provide for the appointment of a Commission to enquire into and ascertain the method of rating adopted by the Board, and particulate a-s to rates levied in respect of • interest nnd finking fund on loans, and in j respect of the raising of the general funds , of ths Bourd, the number and amounts of j !oan« anil the terms of the same and the j lands upon which such loa-ns are charged; the j amount of interest and of pinking fund in | rcppcct of such loans collected, and the portion contributed by the different portions of tho District: the total~*mount of moneys expended since its incorporation by the Board in the various portions of the District, nnd whether such expenditure benefited, and to what extent, any portion of the District other than thopc in which the same was expended; the capital and annual vaJue for each year since the incorporation of the Board of the lands included in the District, and each portion thereof: the amount of rates in the £ levied on lands in the District; the different portions thereof and tho amount collected from tho said District and from each pertion thereof; the yearly cost of the administration of the Board, and the amount thereof charged against each portion of the District; tho total and yearly cost since the incorporation of the Board of cleaning rivers, wator-eoursps.. and drains. tho proportion chnrc;cd cgainst each portion of the District and the ba.°is upon which such proportions were arrived at; and ac to whether Section 2 of "The Christchurch District Drainage Act. ]BTj, \mcndment Act, 1877," has been complied with by tho Board; to Rive to Mich Commission the powers set out in "The Commissioner Act, 1903": To jprovidc that such Commi'-ion shall by warrant determine tho amounts tho Board should equitably havo collected from the various portions of trio District on account of interest on loans, and on account of sinking fund, the amounts which (ho Board should equitably have collected from the various portions of the District in respect of the yearly expenditure of cleaning , , etc.. Rive- Avon. Henthcote, Styx, nnd other water-courses, and in respect of construction and maintenance of works constructed out of general funds, and the yearly coat of maintenance of works constructed out of loan moneys; tho amounts which the Board should equitably have charged against the various portions of tho District in respect of administration having regard to the moneys expended in or for the benefit of the vuri.u! portions of tho District: To provide that tuch Commission shall set otit its findir.ga in debtor and creditor form as between District and tho various portions thereof, and to provide that tho amount found to be due from or to the Board by the various portions of District shall bo a debt owing by or to the said Board to or by the various portions of the District 83 aforesaid: To provide that in arriving at such determination Commission shall treat Section ■2 of The Christchurch District Drainage Act, lfi"j Amendment Act. 1877. and Section 17 of The'Cliristchurch District Drainage Act, 1875, Amendment Act. 1900, as having been in force einco the passing of principal Act: To provido that the Boar* shall provide funds forthwith to give effect to finding of Commission, such funds to be raised by Board by special loan charged on portions of District for which samo raised, and such loans to be raised under Tho Local Bodies Loans Act. 1901. by fpecial order and without taking steps described in Sections 7 to 13 thereof: To provide that tuch loans shall be raised at s.uch rate of, interest (rat exceeding 5 per cent.) and for such term as Board shall think fit; and that no objection shall bo tckc-n to any special rate levied as security for any loan raised under the proposed Act: To provide that the amount found by tho Commission to be due by tho Board to various portions of the District shall bo paid to respective Local Authorities within the. limits of whose jurisdiction the various portions of the District entiled to such moneys are respectively situate: To make provision that the Local Authority shall hold all moneys so paid to meet future calls made by the Board under tho powers conferred upon it by the said Act upon the portion of the District within the limits of the jurisdiction of ouch local authority until such moneys are exhausted: To pro- ; vide that tho costs of such Commission shall be a charge on tho revenuo of the Board, ami to be allocated between the various por- ; tions of the District in such manner as Commisßion determines: To make provision in i connection with constructions of proposed i new works: For notices oi tho proposal to construct such work to be sent to the Local Authority within the limits of whoso juris- , diction the works are to bo constructed, and , slating tho proportion of the cost of work to ( be charged apcinet the various portions of tho District: To proviue that a statement of tho estimated annual receipts and expenditure of Board for the then ensning financial yenr shall be drawn up and sent to the local < authorities interested not later than 30th . Amendment Act, 1302, and in lieu to enact ; that there shall be a Board of eleven per- , ; sons to bo elected, five by the Christchurch City Council, one by the Borough of New Brighton, one by the Borough of \Vool3ton, ; one by tho Avon Road Board, one by the ; Heathcote Road Board, one by the Sproydon , Road Board, and one by tho Riccarton Road Board- To provide that members of present . Board shall hold office until second Tuesday in Juno, 1907, and that on second Tuesday in June. 11/07. the members of present Board . shall vacate their olticee, and that members ] succeeding present Board shall hold office : for three yenrs, ar.d shall vacate same on 1 second Tuesday in June, and that offices of < vacating members shall be filled up by equal . number of qualified persons elected as by Bill provided: To provide that every member going out of office shall bo eligible for re- , election: To provide that oi> second Tues- . day in June 1907 and on second Tuesday in Juiie in each succeeding thrco years the various local authorities shall elect persons possessing necessary qualification-s to be members of Board for three years next ens«i:is date of election: To make provision as to filling casual vacancies occurring on Board: To provide that the repeal of Section 4 of The ChrMchuTch Drainage Act, 1575, Amendment 'Act. 1302. ehsll not effect status of or destroy entity of Board or effect the stntua of the members thereof, and to provide that the Bor.rd shall have power notwithstanding passing of Act. and to complete and execute all suits and proceedings at law or in equity and all matters 1 and things begun or contracted for before passing of Act, and that such members shall continue to be members of the Board until second Tuesday in June. 1307. and for the same districts for which they respectively i were elocted members and every part of the said Act h* shall refer to or depend upon Section SI of the proposed Act altering the constitution of the Board ehaJl bo road and construed ns :f such Section had been originally incorporated in the principal Act: To make provision that nothing contained in the Bill or Act shall prejudice the rights of the Debenture holders in respect of loans alrendv raised under the said Act or any amendment: And to provide that any provision contained in principal Act or any amendment inconsistent with provisions of the proposed Act shall bo repealed.
