\ t Mr V. G. Day, S.M., gave judgment yesterday in ,the case of Police r William Challis, in which the latter was charged with permitting drunkenness in tho Bower Hotel. His Worship said that having considered the evidence, ho came to the conclusion that Ross, Miiligan, arid Columbus were drunk in tho hotel on tho day charged in tho information. Gaptfin Owles was the only witness of any value for the defence, but his evidence only covered tho time till 3.20 'p.m. It wa-s subsequent to his leaving that Milligan's behaviour caused defendant to order him off the premises and send for the police. It was not sufficient for a licensee to simply order a man off his premises. He must tate active steps at once to remove him if he refused to go. Tho evidence Showed that defendant allowed Miiligan to stay. Defendant would be convicted, and fined £10 and costs. As it was the defondant himself who brought th© offence under the notice of the police, he wonUL exercise 1l : b discretion, and not order an endorsement of the license.
