MINE MANAGER'S SENTENCE
(PRESS ASSOCIATION TELEGHJLK.) WELLINGTON, May 9. In sentencing Frank Johnston, exmine manager, of Nelson, convicted of appropriating gold, tho property of the Golden Block Co., Tai Tapu", Nelson, tho Chief Justice said the consideration of tho case had given him some anxious thought. Hβ had considered the previous good character of the prisoner, and also tho place of trust occupied. No loss had occurred to hia employers, as none of the missing gold had been sold. On the other hand, the crime of which lie had been found guilty was a serious one. A large sum of money was involved, and there -had been a breach of trust. Further, he had not been subjected to any temptation. Hβ had a largo salary, and was well off. Tho prisoner had given evidence, and the jury had not believed him. The practice- of himself end;other judges was that in cases in which the accused had given evidence, and that evidence was not believed by the jury, those oasea could not come under tho Probation Act. The sentence would be a nominal one, considering the nature of tho offence. The prisoner would be spntenced to six months' imprisonment with hard labour.
