EQ UEL TO A TIMARU BANKRUPTCY.
The Stipendiary Magistrate at Timaru gave judgment for defendants yesterday in a case in which the Assignee sought to recover £50 from the Canterbury Farmers' Co-operative Association being money retained by them as part payment for a crop of turnips they sold for a Waitohi fanner, who owed them £1400, and subsequently became a bankrupt. Counsel for the Assignee contended that as the £50 was not earned till after the bankruptcy, the defendant Association was not entitled to the money to the exclusion of other creditors. The magistrate held the money was earned from the date of the original agreement, which was before the bankruptcy.
