Hardcastle y H. G. 'Shepherdf in which £3 was claimed for da-twee''to certain i_rticles of, furniture belonging to the bankrupt, by the bailiff of the holder of an unregistered bdl of wile when lie attempted' to~ eject tho bailiff ofthe Official Assignee. His Worship said that m his opmion Hftrcfcastle possessed an interest iii the furniture'''claimed-,''" and'that'on'his bankruptcy that interest passed to tfc*. Official Assignee, who liad a right of action against < the defendant, and having shown a certain j amount of damage,' lie was entitled to I the judgment of the Court. Although the amouritof claim was excessive, it was really more a matter of getting the principle c*_- : tablished than for damages. Judgment would .be given for "the plaintiff for £1, with costs and' solicitor's fee. Leave to appeal was granted, and his Worship ordered a stay of execution for seven days. Mr Stringer appeared for the plaintiff, and Mr Francis (for Mr Harper) for the defen- j dint. [ i PRESENTS OR WHAT? I Sydney S.
