SITTINGS AT NISI PRIUS
Wednesday, September 13.
(Before bis Honour Mr Justice Dennis ton.) The civil sittings of the Court was resumed at 10.30 a. m. * BRETT V COX. The hearing of this case, which was for the cancellation of a guarantee, was con-' tinued'. For the plaintiff Mr Bruges; for the defendant Mr Harper, with him Mr Beswick. At the close of the case for the plaintitf, ■ Mr Harper applied that the plaintiff should be nonsuited on the grounds—(l) That the Official Assignee, having been discharged from, has trust, had no locus stkndi in the cause. (2) That <the representations as alleged in the statement of claim came within Lord Tenterden'a Act, and should have been in writing. (3) That these representations were not contained in the subsequent written agreement between the parties. His Honour declined to nonsuit the plaintiff. Mr Harper opened the case for the defence, and led evidence. At the conclusion of the evidence, it was arraneed that the legal points in the case should be argued at a later date. The Court then rose. '
