Tn.DRSPAY. January 5. (Before R. Beetham, Esq., S.M.) Civil Cases. — Automatic Calculator Company, Limited, v Pitcaithly, claim £7 10s. Mr Maude appeared for the plaintiff Company, iUr Deacon for the deience. G. W. Hulme stated that the defendant had applied for, and had been allotted ten shares in the Company; the application fee and allotment fee and a call, in respect of the shares, had not been paid, and was now sued for. Cross-examined—The Company was formed early in 1897. Prospectuses were ciroulated, which set out that the purpose of the Company was %to acquire from the inventors tne patent rights of an invention to automatically calculate the price of goods bought and sold by lineal measure. After the Company had been formed and shares taken up, it was found that there was, in existence, another patent on similar lines, and the directors, for tlxe benefit of the Company, purchased it, paying, or undertaking to pay for it, £50 cash and 300 shares in the Company. Al? this stage, Mr Deacon requiring the production of all agreements and contracts entered into by the directors, the case was ad j owned for .that purpose till January 9th, the plaintiff Company being allowed £1 Is costs. Judgments went for plaintiffs by default, with costs, in—Stephens v. Rainbow, £27 lbs lid; VVarnes v. Rees, £14; Bowron Bros. v. Mcpherson, 15s Id; and McDougall v. Williams, £2 10s 4d. In Williams, Stephens and Co., Limited, v. Vale, a claim of £4 14s 3d ort judgment summons, the debtor did not appear, and was ordered to pay forthwith or, in default, two weeks' imprisonment.
