IN ADMIRATY JURISDICTION.
RK BARQUE DILPUSSUND. This was an action in rem. brought by the Bunk of Australasia against the barque DUpussuud to recover the sums of £900 and £132 on promissory notes. Mr Wilding for the plaintiff Bank; the ship was not represented by counsel. Captain Reed deposed that he commanded the barque Dilpussund. In February, 1895, Captain Craighead was in command of the ship, and witness was chief officer. The ship was then in New York. He recognised the signature of the captain to the promissory notes produced. They were made for disbursements necessary for the ship. Mr Wilding said that the writ had been served on the ship, and the claim admitted by Mi* Barns, of the firm of Kinsey, Barns and Co., who held a power of attorney from the owners, tiie executor, of Capt_in Hanks, deceased. The only other claim against the vessel was by Captain Reed for wages and disbursements. Mr Wilding said that as regarded the claim of Captain Reed Messrs Wilding and Lewis had given an undertaking that the claim of Captain Reed should be a first chai-ge on the proceeds arising out of the sale of the vessel. Witness Baid, on behalf of the owners, he did not offer any objection to the claim of the Bank. His Honour gave judgment for the plaintiff Bank for the amount claimed, with 6 per cent. f.«m date of dishonour of the bills and co3ts a3 per scale.
