(PRESS ASSOCIATION TKLEaRAM.) AUCKLAND, Deceml>er 16. At the Supreme Court to-day, in banco, Mr Justice Conolly heard an important motion to reverse a decision of warden Kenny in the Cardigan Extended mining property at the Thames. The property was pegged out on. September 24th, 1895, and the first hearing was fixed for 24th October. The plans, however, were not put in and the matter stood over till the 24th of Maroh, 1897. On the Ist of April, 1896, Dean, the present objector, pegged out the property, and on the same day an application was made to the Warden, who granted an extension of the time for producing a plan to three months. The argument arose on the interpretation of section 125 of the Mining Act of 1891, Mr Cotter stating that neither himself nor Mr Cooper, who appeared for the respondent, had been able to find a case on the point. After a long argument his Honour held that a plan not having been lodged within six months of the original application having been put in, and the extension of three months not having been granted before the expiry of that term, the ground had been abandoned under the meaning of the section. The appeal -was dismissed with costs. Considering the near approach of the Christmas holidays the demand for mining stocks is well maintained, and compares most favourably with the state of the market for the last two years at this date. There was decidedly an improved demand for Thames stocks to-day, but transactions weys not numerous, as sellers are not eager to accept the prices offered. Bc-rs-39 Don***. Sales. Sellers.
