Assault. —Thomas Caoniog was charged with unlawfully assaulting one Jiel Jiarsnd. a foreigner, ou Sunday afternoon. J iel Durand, sworn, said thac when he came oat of the Sailors* Home pa Sunday the accused met him, and insulted him, then the accused struck witness. "Witness then closed with accused, and, in self-defence, struck him. P;ior to the assault the accused had pat Ms hands into witness' pocket; be had some money in it. Witness took accused's hands away. Mark Thomas said he saw the last witness trying to j?et away- from the accused. Be never struck at him until the i accused had twice struck out at him. — Rhind gave similar evidence. He also said that he heard the accused make use i of fool language. The accused was not sober. The accused i a his statement said that he met the complainant on Sunday, and said " Hollo, Frenchy," and Pat hit hand on his shoulder. Complainant pushed his hand off, that was all. There was a crowd down at the corner- who saw it. In giving judgment the Bench said there .was no doubt that an assault had been committed* He would be 3ned 40s, , or, in default, fourteen days' imprison-
