Esq.) \ Damaging Fences.—W. Dickie, jun. and J. Graham were charged with having on November 29th, damaged the garden fences of T. J. Burnett, value 12s 6d; and of J. Monk, value os. Defendants pleaded "Not Guilty." P. Hemblinar, licensee Kaikainai Hotel, said accused left his hotel at closing time after bavins a glass of beer. Whilst he was extinguishing the outside lamp at five minutes past ten, and« speaking to Mr Bosustow, he heard some.' one breakingthepicketsof Mr Monk's fence,? There seemed to be no other parties on the road at the time. F. Bosusfeovr said he savf defendants leave the hotel in che direction of the property damaged. Mrs Dnscoll said she resided in Mr Burnett's cottage when the damage was done to the fence. She went ont and saw the defendants. Graham; denied it, but she did not speak to Dickie. B George, residing between the hotel ana Dlace of damage, gave evidence that his sliD Danei had been taken down, and one] to break the pickets on the fences, half of the rail being left among the wreck at Burnett's. Fines APPUCATION.—Mr GAUen asked the Bench if it would allow time to pay the fine rather than send the defendants in last case to gaoL The Resident Magistrate said Magistrates were always loth to commit persons to orison, and if Mr Allen would undertake that the fines were paid, his application would be granted. In reply to the Bench, ! Graham said his wages were los a week at the woollen factory. The Resident Magistrate pointed out this was a very Rood wages for a youth when many men were glad to get work at wen lower sums, and counselled him that he had better conduct himself properly in order to retain his situation. Mr Allen offered.to have the fines paid in a month, which was agreed to. In case the defendants failed

in their agreement with Mr Allen, the fine to be enforced, the Bench expressing a high opinion of that gentiemaa's good nature towards the defendants. _ ' Qrvrx.
