SITTINGS IN BANKRUPTCY. Tuesday, October 15. ; (Before Mβ Honor Mr Justice Donotaton. His Honor sat in bankruptcy at 11 a,m.< REB.E. DONOIXY. . This case, which was an application for the discharge of the bankrupt, was *$t> journed until the 22nd instant. '' BE JOHN GKUBB. Mr Meares applied, under section 187 pt the Bankruptcy Act of 1882, for an order of discharge to be used as evidence in the Court at Auckland. The debtor had beett declared bankrupt gome three years before. ■■..■' His Honor pointed oat that in section 185 it was stated that ipso facto a bank' rupt should be deemed to be discharged at the expiration of three years. There wtt*, therefore, no reason for the Court to make an order of evidence of the discharge of the bankrupt. The Legislature only intended that the Court should discharge the debtor, not make evidence of such discharge. He could not certify that he, by the document, discharged the debtor, as he was already discharged by efflcurfon of time, and the Court had no power to do 80. ! Order refused. RE JOHN MOBRIS MORGAN. .> Mr D. Wynn-Williams applied for oa order for payment of cost* out of tl» bankrupt's estate. His Honor made the order. KB ABTHT7R MUNSON. Mr Russell applied herein for the di*» charge of the debtor. ■'••' His Honor made the order. The Court then rose.
