SITTINGS AT NISI PRIUS.
The civil sittings of the Court were then commenced. WABNBB V COTTON. On the application of Mr D. Wynn-Wil-liams for the plaintiff this case was adjourned. BENKBTT V PAWBON. In this case the plaintiff and defendant were sureties, under bond, for the payment of the rent of the Commercial Hotel, Kaikoura, to one Mitchell, on account of one J. B. Barker. Barker entered, into possession of the hotel, and carried it on for some eighteen months, when he became bankrupt; and, subsequently, Pawson entered into possession, and carried it on for some time. He then found that he could not carry on, and negotiations were then opened up with Mitchell to execute a release of the bond. Subsequently he agreed to accept £300 to release plaintiff and defendant from the bond respecting the rent. The plaintiff paid this sum, and the release was executed. The plaintiff now sued the defendant for his half of this £300 so paid. The defence was that the defendant had paid more on account of the bond than the plaintiff had. Mr Loughrey for the plaintiff, Mr Slater for the defendant. After the evidence on both sides had been taken, counsel addressed the Court. His Honor gave judgment for the plaintiff for the amount claimed, with costs as per scale. The Court then adjourned until Monday next.
