His Honor sat in banco at noon. adjournments. Ths follawing- cases stood over:—Morlinf < Ward and Co., May v Union Steamship Company (Wednesday), Finlay v Oxford Road Board, tulcock v Geraldine Co'iuty Council, Cook v Carter, Hadtield v Partridge. Buddie aud Co.; and Vincent v the Queen. KINLEY (APPELLANT) V FLACK (RESPONDENT). This was an appeal against the decision of Mr Beetham, R.M.. at Christchurcb, in a case in which die respondent was plaintiff, und the appellant defendant. On the trial a receipt in full was produced, which, it was contended, was an estoppel. The Resident Magistrate, however, fouud, on the case,,that the receipt produced was written by the appellaut, and signed by the respondent without reading it, and without his being aware of the purport thereof.
Mr Bowman for the appellant, Mr Russell for the respondent. After hearing Mr Bowman, and without calling on Air Russell to reply, His Honor gave judgment, dismissing the appeal, with costs, £7 7s.
