Saturday, February 2. [Before C. Whitefoord, Esq., SJC, and H. J. Hall, Esq., J.P.J Drcnkknnbss Annie Wharton, for this offence, was fined 10s; for a first offence a man was fined sa, each in default with the usual terms. Alleged Labckny.—The case against John Black, charged with stealing at Lyttelton, on October 20th, a silver watch valued at £5, the property of Edwin Lusher, was further adjourned for seven days, on account of the absence of the prosecutor. The original bail was enlarged. Interpleader.—ln the case of Danks v Rogers, in which a judgment had been given for the plaintiff, and in which execution had been issned, A. W. Swift now claimed as his property a horse and cart which bad been seized under the said execution. Mr Beswick appeared for the claimant, Mr Bruges for the execution creditor. Mr Swift stated that in 1887 he built and delivered to Rogers the cart, charging £20 for it, and a horse for which £5 was to be paid. Rogers said he would pay for them in instalments, and an agreement was drawn out by which it was stipulated that although the horse and cart had been delivered to Rogers, they were not to become his property until the purchase money had been fully paid up. This agreement had since been lost. There was £10 still due on the property, and the claim was now made under the agreement. After hearing evidence, an order was made that the claimant receive out of the proceeds of the effects seized, the money due to him, with, in the case of the horse, the option of re-dellvery.
