re c. h. banks. On the application of Mr Martin, for Mr Stringer, his Honor fixed the usual day for application for discharge. P.E WILLIAM WAITES. Mr Leatham applied herein for the bankrupt's discbarge. The Official Assignee said that in this case the preference claims had not been fully settled, as they had received a dividend. His Honor said the case had better stand over till after the Court of Appeal. RE E. J. T. FORD. Mr Kussell appeared in this case to speak to it. The matter had come before the Court'on aD application for discharge, to which the preference creditors had relinquished their claims. His Honor took time toconsider whether this wasa payment under the Act, which said that all preference claims should be " fully paid and satisfied" before the bankrupt was entitled to his discharge. Mr Kussell quoted a case in Dunedin where Mr Justice Williams had held that the preference claims, having received a dividend and signed a release, were fully paid and His Honor now said that it would be betcer for the case to stand over until after the Court of Appeal. The Court then rose.
