Plaintiff said he was I caHed to attend defendant's .son, suifering j with a compound fracture of the thigh. He attended the boy at Southbrook during May, June and July, with Mrs Martin's acquiescence. Healsoattendedtbepatienfc ! in Christchureh, and feeling an interest in I the case went to town two or three times ,! free of charge. One part of the injured I bone did not get flat, and he told his I I mother that it would entail an easy operaj tion to remove it. The father had com- ; i plained that he was to blame for the further operation, and wlipu he sent his account. Martin wrote saying the claim was outrageous, seeing he had to pay two other doctors, and would only consider the claim reasonable if divided by tw*o, also that he had become bankrupt some days after the accident. He (plaintiff) did not think defendant was hard up ; but he offered to reduce the amount by one-third, and gave easy terms of payment. To this he had no repiy. Mr Helniore said the defendant s letter with the fact that Mrs Martin agreed to Dr. Clayton's treating the case completed defendant's liability. The-Resident Magistrate —The defendant is not here to dispute it, and judgment will be by default with costs. M. bklaark v Gurney, £1 lis; I judgment for plaintin'.
