A HUSBAND'S LIABILITY.
In tbe Besident Magistrate's Court yesterday morning, Mr White!ooid, E.M., gave judgment in the case o! JJearman and wife ■» ■ Ebeling. The case had s:>me remarkable features, and, being, in a way, an endeavour to retrieve ground lost in a superior court, was novel in New Zealand practiceSome time ago the defendant's wife brought a suit agAinsfe him for judicial separation on the ground of hisc.uelty, but the action was dismissed 'by the Divorce Court in consideration of evidence, which was brought, cf tbe wife's own gross misconduct. No order was made as to costs, and, security for them not having been taken from the husband beforehand, they were abandoned. The plaintiff* were witnesses for. Mrs Ebeling in the suit for judicial separation, and they* in the present action, sought to recover their expenses for thit service. Mr Weston appeared for plaintiff, and Mr Kippenberger for the defence. Argument had been heard at a previous sitting, and the Magistrate now gave judgment for tha defendant, with costs.
