This was a case in which the accounts in an alleged partnership estate were before the Registrar for report Mr Harper now applied for a direction by the Judge to the Registrar on certain matters. Mr Cowlishaw objected, on the ground that the matter was sub judice, as the Registrar had made no report. Hence he submitted that the Registrar could not be interfered with. His Honor thought he could not entertain the application. The ordinary course would be for the Registrar to re-' port, and then upon the motion for a decree there might be an application to vary the report. The matter stood over until the Registrar made his report.
