Thursday, September G. [Before His Honor Mr Justice Johnston.] His Honor sat to hear the legal argument in the case of STURE V UNION STEAMSHIP COMPANY. This waa a case which was tried at Kist Priuß on August 15th, before His Honor, without a jury, The plaintiff's claim was for JE4OO, value of a bull shipped by him on board the Tarawera, and lost, as he alleged, during the voyage by the negligence of the servants of the defendants. The defence was a denial of all the material aUegations, and of negligence on the part of the defendants' servants. That the bull had been placed in a pen constructed under the plaintiff's direction, and that the plaintiff himself was in charge of the bull at the time of the accident, and that it was due to his neglect that the bull was killed. The plaintiff enlarged the pen, aud let the bull loose, thus contributing by his negligence, and that it was duo to this that the accident took place. The defendant further denied the value of the bull as claimed, and the loss of time, _c, a&_Ufi_£d by. him.
