KAIAPOI.
Friday, December 24. (Before C. Whitefoord, Esq, 8.M.) ; Larceny as a Bailee.—Edw. M'Kenna t was charged with the larceny of a horse, , value £35,, the property of Thos. Fraser. Mounted-constable Morice, stationed at . Christchurch, arrested accused. He met L him on Lincoln raad and told him be wanted him, when he bolted into some willows and swam the Haiswell. The constable, after , . twenty minutes' search for him, found him in Jennings Moffatt's garden. On being > cautioned, he Baid, " I suppose I shall gob , three years." T. Fraser, mail contractor, Waiau, said—On Sunday, November 14th, accused hired the mare outside the Court, saying he wanted to catch the Monday's coach to attend a wedding, and would return on Wednesday and pay £1 for its hire. Witness identified and described the mare outside the Court. Had given him no authority to to dispose of it. He next saw it in a paddock at Kaiapoi. G. Osborne, general dealer, said about November 25th accused sold him the mare in question for £13, telling him he had a mail contract at Hurunui and plenty of horses besides this one Constable Haldane said from information that a mare had been stolen from Fraser, he took possession of the one outside the Court. It waa tethered on a bye-road on Raven Quay. Accused, being cautioned, said he had nothing to say, and reserved his defence. He was then committed for trial, the magistrate saying bail would be accepted in two sureties of £100 each. Inspector Barsham objected to bail, as accused had tried to escape. The Resident Magistrate wished to remind the police that the question of bail rested with I the magistrate.
