On the motion of Mr Jameson, the Court made an order of adjudication, first meeting of creditors to take place on the 27th of December, at 11 a.m. final examinations. v-i The following bankrupts were ordered to appear for final examination on the 12th of January next, at 11 a.m.—Joseph Christie, W.J. Falloon. W. Bartlett, Frank Weber, E. Weston, John Bigwood, and George Musson. AUSTRALIAN CREDITOBS' ACT AND MODOUGAL V BROWN. In this case Mr G. Harper, for plaintiff, obtained leave to issue a new rule, calling on defendants to show cause why execution should not issue on payment by plaintiff of the costs of the day. Rule returnable on the 23rd of December. GILMORE V BRUCE. Mr Joynt for plaintiff, Dr Foster, instructed by Mr Cowlishaw, for defendant. This was a motion for leave to enter up judgment on default of plea. The writ and declaration had been served os 12th October last, and plaintiff contended that as the time for pleading (36 days) had lapsed, he was entitled to enter up judgment. Before the expiration of the time to plead, to wit one day, defendant had caused a summons to issue to plaintiff to amend, but before the summons became attendable the time for pleading had lapsed. The point for decision was whether the defendant was not entitled to compute the time for pleading from the day on which the summons was issued, instead of the day on which it became attendable. After argument, it was arranged that the matter should stand over until Tuesday next. His Honor then rose.
