The*.opinion of the Chief Justice was in favor of the appellant, butifihe Cpurfc-'held that the Southland Waste Lands Act Amendment Act, 1873, was intended to apply to the waste lands of the Crown, although in the occupation -of holders of pasturage licenses, and (Dissentient Prendergaet, C. J.) that the power of the .Superintendent to set aside the lands for sataLpn deferred , payments, had been duty exercised with regard to the lands in question. The four questions proposed by the case are therefore answered in the affirmative. Judge Johnston also read a written judgment in concurrence with that of Judge Williams. Mr Bell on behalf of the appellant moved for leave to appeal to the Privy Council, but it was refused on the ground that the Queen's Order in Council gives no power to do so. He will petition the Governor in Council for leave to appeal to the Privy Council. The judgments were very long. Bluff, Dec 2. The Adamant has been declared a clean ship. There were five deaths during the passage. The captain died about six weeks ago. The vessel is not yet anchored, Dunedin, Dec 2. After Hon Mr Reynolds concluding his speech last night, Mr Wales wasalso to baveaddresaed the meeting. He asked them to take his speech as read, and he would publish it in the papers. The meeting objected, as he will be asked lots of questions. He speaks in a few days. The provincialists at last night's meeting were present in great force, nearly all the late Macandrew banquet people. Bir John Bichardson positively declines to contest Dunedin city. He will state his reasons to the requisitionists in a few days. Williams, the jockey, who got such a cropper yesterday in the hurdle race, has recovered consciousness, and may pull through.
