r YTTELTON BOROUGH COUNCIL, In Pursuance of Clause 189, Municipal Corporations Act, 1867, the above Council hereby give notice that they intend to consider the undermentioned draft bye-law on 21st day of JUNE NEXT. mx/^T DRAFT BYE-LAW AND REGULATION AS TO KEEPING SWINE. A Bye-law of the Borough of Lyttelton, s made under the Municipal Corporations Act, 1867. . . _, ' In pursuance of the 186 th section of Ihe Municipal Corporations Act, 1867, the Council of the Borough of Lyttelton, ordain as follows:— . . j- t From and after the coming into force of this Bye-law, save as hereinafter ex- ' cepted, it shall not be lawful for any person to keep any swine within the ' Borough. Provided that any occupier of land not being less than twenty J acres in one block, may keep swine : thereon, but such swine shall not be kept withiu sixty-six (66) yards of any town section of the Town of Lyts telton, or within sixty-six yards of s any public road or thoroughfare in ihe said Borough, or of any dwelling house the owner or occupier of which i, objects thereto, such objection to be made in writing and sent by the party objecting to the owner or person keeping the swine in question. Any per- ;• son keeping swine within the distance above-named, and who shall not ree move the same within forty-eight hours after the delivery of such notice 3 as aforesaid, shall be deemed to have I committed a breach of this Bye-law. Any person lawfully entitled to keep swine on his premises who may allow such ewine to stray within tbe limits within which swine are hereby forbidden to be kept, shall be deemed to have committed a breach of this ByeII No person having the charge or custody of any swine that are brought into the f Borough within the limits hereinafter n forbidden, for the purpose of sale or in c the course of transit to some other place shall allow them to remain therein more than twenty-four hours, The penalty for any breach of or offence against any provision of this Bye-law shall be a sum of not more than Five pounds, nor less than Ten (shillings to be recovered in a summary manner before any two justices of the peace t . in the manner provided by the said a. Act. 0 ' The penalties hereby imposed shall not j- attach to any poundkeeper, or any person impounding pigs, by reason of ;3 such pigs being or remaining in tbe _ public pound. n The Bye-laws or parts of Bye-laws hereinjf after specified being all the Bye-laws or parts of Bye-laws or regulations heretofore in force in and for the said Borough of Lyttelton, which are inconsistent with or repugnant to the said provisions, or in any respect deal or _ purport to deal with the subject o- matter of the said provisions are ;o hereby repealed, namely, Clause I of the first subsection of part VIII of the 13th Schedule of the said Act adopted by the Council, at a meeting held on the 13th day of July, 1868.
