M-SIDEKT MAOISTEATE's COCETj April 4, 1863. [Before R. JLattee, Esq., J.P.] Charles Wilson, who is at present in gaol, as a deserter from the Homan Emperor, was charged with stealing a pair of boots, the property of Auguste Plagcr, a seaman on board tho same ship.

Plager missed a pair of boots tho morning after prisoner hod deserted from the ship, and did not see them until they were produced by the Sergeant of Police, when he identified them as his property.

, Sergeant Sugrue deposed: jl took tho prisoner into custody on. the morning of tho 2nd instant wad on searching his bag found a pair of boots which he said did not belong to him, and he knew nothing about, them. It ultimately turned out on examination of the prisoner that when he and others determined to run away from the ship one of his mates hod packed up his bag. Tliis had not been opened since, except by tho police. It •was evident that tho boots had been placed there by mistake. Case dismissed.

August© Plager (the owner of tho boots) was immediately taken into custody on a charge or desertion, and together with Pat ri-k Mulcahy, who -was again brought forward on a charge fof broaching, cargo, was remanded for further examination on Tuesday next
