MTTNICIPAt COTOCIL. Tho Council met as usual at tho Besident Magistrate's Court, on Friday evening, at seven o'clock. All tho members present except the chairman; tho choir was taken by Mr. J. SWilcox. The Chairman read a roport from tho deputy Surveyor respecting tho road in Dampier's Bay, which, he considered was in a very dangerous state, and ought to bo ropaired forthwith. The deputy Surveyor stated in this report that the well in Dampier's Bay was completed, as far ac seventy feet There was a very good supply of water from a spring winch was opened during the sinking of the last two feet, and ho recommended that a wall bo built at once, from tho mouth of the well nearly to the lovel of the road, as otherwise all the water from the road would wash into the well, and make the water there muddy, besides filling it with clay. Mr. Grubb gave notice of motion that tho road across tho gully, and a wooden culvert, should bo immediately commenced in Dampier's Bay, and tho road bo mado in a good stato of repair for the winter. It was also recommended by Mr. Fyfe that tho road should bo cleared, so that tho water could not intorfero with tho bridge leading to the gully, but tho consideration of this subject was deferred. The deputy Surveyor was instructed to prepare an estimate of the cost of tho above work, to be laid before the Council at the next meeting. The second roport from the Nuisanco Committee was then read, when clauses 1, 2, 3,6,7, 8, and 9, were adopted. Clause No. 4 was expunged, and clause No. 5 was adjourned for discussion at a future meeting.
The Deputy-Surveyor said that in coaaequenca
of the prisoners having been busy in London-street, no steps had as yet been taken towards metalling the roadway in Oxford-street. The Secretary stated that notice had been given to J3cott to remove his house within the prescribed timo. The Secretary was instructed to give notice next meeting respecting complaints which may be made against tho alterations proposed to be commenced in London-street, and also to claim from residents on Norwich Quay their proportion of expenses incurred by laying down drains in that locality. Moved by Mr. Fyfe, and seconded by Mr. Genet, that a wall round tho well in Voelas Road bo built (if possible by the liard labour gang), and bo commenced at once. —Carried. Mr. Genet wished to know if tho Council had any jurisdiction over the hard labour gang, stating that some of the prisoners had been removed to Cliristchurch, and wishing to know by whose authority this had been done. The matter was allowed to stand over for a week or so, that the Resident Magistrate might be consulted. Mr. Preeco brought forward his motion respecting tho vote of £25 for enlarging the shed for the prisoners. Mr. Ellis seconded tho motion, which was earned. A letter was read from tho inhabitants on the south side of London-street, praying that the footpath on that side of the street should be paved either with stone or asphalte, and offering to bear one half the expense.
Mr. Prceco moved and Mr. Ellis seconded— "That tho Surveyor bo instructed to take the levels on tho south side of London-street, with a view of having the above work commenced." Tho following accounts were received and ordered to bo paid, viz.:—Pearson's cartago account from 26th February to 25th March, 1863, £24 65.; England, Brothers, account for building watercloset at the hospital, £5; Doile and Co.'s account for sinking well in Yoelas Boad j paysheet as rendered by Hodgson, £14 7s. The Council then adjourned. Tho following is tho Eeport No. 2, on Nuisances :— " To the Municipal Council, Lyttelton. "Gentlemen, —In accordance with your instructions we have considered tho best means of removing the nuisances mentioned in Eeport No.l. "1. That no person should be allowed to construct a cesspool without leave being asked and obtained from the Council; and cesspools already made to bo condemned if they ore injurious to wells, or in other respects a nuisance. "2. That whero cesspools are not allowed, occupiors or owners of houses should be compelled to provide privies to the satisfaction of the Council, such privies to contain a zinc pnil, or tight wooden top properly covered. "3. That all houses should be provided with receptacles for rubbish, offal, and vegetables refuse, so that such rubbish &c. might bo removed when necessary. " 4. That any person may bo allowed to construct a privy in connection with a dust or rubbish bin ; such places to bo kept in such a inannor as to prevent any nuisance.
" 5. Tliat all houses shall bo providod with a cask for containing slops, Sus., such slops, &c, to bo collected by the scavenger appointed for the purpose, who ought to provide, or be provided with, a lnrge cask on wheels, so that such slops may bo conveyed to the sea bench. " &. All night soil, not deodorised, unmixed with rubbish, should be put into the sea some distance below high water mark. " 7. "With respect to the selection of a site for depositing rubbish, if it is merely desirable to get rid of it without any consideration of its possiblo utility, no better site can bo found than along the Sumuer Road ; but your committee would recommend that the Surveyor be directed to set up a notice board on the spot most suitable for the purpose. If tho Council tlu'nk it necessary to utilize tho rubbish, spots should bo chosen where there were any irregularities of ground that would : hive to be filled \ip, and which would bo best known to tho Surveyor. " 8. Kespecting the list handed in with Eeport ; No. 1, your committee recommend that notices to abato the nuisance be forthwith served on all persons who have privies opening ovor the gullies, or which aro in a state offensive to the neighborhood ; also, that notice bo served on all persons having pigsties on any premises containod within tho block of land situated between Winchester street and Norwich Quay on the one side, and between Dublin street and Oxford street on the other, directing such persons to remove the same within the period of six weeks from such notice. "3. Your Committee would also recommend that the owners or occupiers of property through
■which there run 3 a water-course should receive notice to keep the s»mo clear of impediments ; or if such owners or occupiers could not be proceeded against, that a bye-law bo made to meet the case. (Signed) " Jons Geo. Ftfe, " TIIO3. PBEECE. " Lyttelton, March 27, 1863."
