Order at a special meeting of the Whakatane County Council held on 22nd day of October, 1940, making a By-Law to be knoAA'n as "The Whakatane County Council Ohope Beach Motor Vehicle By-LaAv, 1940," viz: IN PURSUANCE and exercise of the powers and authorities conferred upon it by "The Counties Act 1920" 'i and "The Motor Vehicles Act 1924" r and the amendments of those Acts respectiA r ely and of all other poA\ r ers and authorities it in this behalf enabling, The Whakatane County Council DOTH HEREBY by this Spe- ( cial Order MAKE AND ORDAIN the. folloAving By-LaAA r —that is to saj r — (1) IN this By-Law unless inconsistent AA'ith the context the folloAVing expressions shall haA T e the meaning hereby assigned to them:— "The Council" means the Whakatane County Council. j "Motor Vehicle" means any vehicle 1 that is draAA'n or propelled by 1 mechanical poAver and includes 1 a motor cycle. 1 "Ohope Beach foreshore" means all ~ that the sand beach and/or fore- ~ shore at Ohope in the County of ~ Whakatane Avhich is under the ~ control and management of the Council and extends from the ~ cliffs at the Western end of the Ohope Beach in an Easterly direction along the said beach to the mouth of the Maraetotafra Stream, and down to low-water mark throughout the full length thereof. 1 Words importing the singular number include the plural and vice * A^ersa., (2) NO person shall drive or ride any motor A r ehicle on, over or across or along the Ohope Beach foreshore or any portion thereof at a greater speed than TWENTY MILES per { hour. (3) NO person shall drive, ride, haul, I take, leave or park any Motor Vehicle upon, OA*er, across, or along any t portion or selected area of the Ohope Beach foreshore Avhich the ( Council may at any time and from time to time by Resolution declarc for any purpose or for any special function or for any special period i or periods to be a prohibited area ■] for Motor Vehicles, at any time . Avhile such prohibition shall be in force and effect and shall he publicly notified by Sign or Notice erected and/or placed on, at or near to, or at the entrance of, such prohibited area.
