The following information may be helpful to the many clients who made enquiries about an auction sale, where we sold the business as a going concern. An auctioneer must carry out his client’s instructions, provided such instructions are not misleading or dishonest. The auctioneer acting as agent for the vendor can sell by private treaty before the advertised time of the auction, if so instructed by the owner. The owner can withdraw his property from sale even after the auction has commenced, but not after the auctioneer has made a sale under the usual auctioneering terms and conditions. R.
