The caße of Ah Foy v. Collector of Customs, in which plaintiff, a Chinaman, claimed damages for not being allowed to and recently, was heard on Monday before the Court of Appeal, Melbourne, anda verdict was returned for the plaintiff, damages to be hereafter assessed. The con* tension for the defence that the ratification by the Government of the powers of the Collector of Customs was equal to ratification by the Que^n, or the power of the Victorian Government to advise the Queen in matters of State, was held to be untenable. The Chief Justice disagreed with the verdict. An appeal to the Privy Council is regarded as certain to follow. In the Appeal Court case of Holt, exmanager of the Bink of New Zealand, who appealed against the decision of the lower court handing over his interest in the Rose Hill estate to the bank, the appeal was dismissed. One of the principal Southern coal mines of N. S. Wales was discovered to be on fire on Tuesday, and it is suspected that some of the men on strike are concerned in the affair. The flre was fortunately extinguished before damage was done. The Sydney horse market is doll. A shipment from Canterbury, ex steamer Waihora, was put up to auction on Wednesday, but was unsold.
