EJ&^ Jopp, landlord of the Newniarket HStel, was charged, on the information of Sergeant Cobden, with al Wingiperspris to remain iD his house in a state of intoxication, contrary to the ordinance. The Policeman stated that he went into the Newmarket Hotel, Clutha JPerrjj a little after 12 o'clock, oh Wednesday evening' the 27th September, and saw a number of persons in defendant's house in a state oiintoxibation. He asked Robert Smith, . the person in charge of the house at the: time, if he was not going to close the house, who replied,. 'he had_ not fully made up his mind yet/- • Smith-then commenced writing the names of the persons in the room on a slate, and collected, 2s 6d each from them, in payment for their beds for the night. He (the policeman) then* went outside the house, and, after watching" some time, saw. the persons he had seen inside the house come out and go away.
