♦ ■ ■■.'■•■ The appeal in the ease Gurr v. Gallien was heard in the Supreme Court at Palmerston North, to-day, before his Honor Sir Robert Stout, Chief Justice. Mr Lloyd (Dannevirke) appeared for the appellant Gallien, and Mr Cooper (Palmerston) for the respondent Gurr. The appeal was from a judgment of the Stipendiary Magistrate at Dannevirke, in which Norman L. Gurr recovered £34 10s commission, on a sale to Major Gascoigne, which, proved abortive, of Mr H. L. Gallien's property at Hastings. After hearing argument, his Honor allowed the appeal, with £5 os costs against respondent, and directed that a nonsuit be entered in the Magistrate's Court, on the ground that respondent exceeded his authority in entering into the contract with Major Gascoigne.
