Skjottrup, judgement summons, no appearance of the defendant, claim £14 12s 10d> f Defendant was ordered, to pay amount claimed in monthly instalments of £2, first to be paid on January 4th, or 14 days in the '.JNapier/gaolv : • ■ Walter Mansell and his mother, Mrs Martha ManfelJ. were, charged ;at the instance 0$ the KpoUceviwifH • assaulting Ethel May Barry, aged 11 year, at Eopua, on .November 3rd. , ; Sergeant Cruickshank conducted the prosecution. . n r The / boy pleaded guilty, and Mrs : Mangell gnilpy under pro vocation. : :'•/;■> ? i • "James & Grant, railway guard, remembered the boy and girl with other children being passengers by the train on the afternoon of November 3rd, on arriving at Kopuii the girl came to him bleeding freelyi and as well as she was able, said she had been struck by the boy whom she pointed out; called the boy and demanded his ticket with a view to getting his name/, he then .told me who he was, Hjs sisters had gone home, which isi in the station yard.. The mother, then came but and met Ethel Bairy a short distance from where I was, and while still bleeding struck her a number of blows across the head ; remonstrated her and £old her she was a disgrace to her. sex, since which Mrs Mansell has '"thrown -off" at me' when the shunting has been going on past her house. Ethel May Barry said she rememb ered the 3rd November, being in the train with other children.; Walter Mansell came into their carriage and was rude so we turned him put ; he said he would break my neck when we got out of the train ; as I stepped off the train he struck me on the mouth and cheek with his ,-fisfc, bruised me and cut my lip ; the iblbpd poured from my mouth ; when going home Mrs Mansell ran up and hit me across the : head with my hat; couldn't comb, my, hair for a week ; aever kicked. thY boy; :,.. ~ Fradericlc C. Schwass said he was a passenger by the same train as the hist witness' and other children on November 3, and in the same carriage, the children in a different .compartment; saw the boy strike the gM at Kopua, saying "you f ,^ou kicked me in^flie carriage"; the girl stood for some tune with her mouth bleeding: and then went towards tha guard's yah; she was afterwards met by Mrs Mansell, who gave her tyrp or tjttrj&e slaps v with the hand and struck her with her cap, which had fallen off ; thought the assault was a severe one.
Mrs FrancisJlngram, grandmother of Etkel Barry, was at home when her grandchild arrived on November 3 crying and bleeding from the mouth; she has not been well since, and complains of her head now ; she is a good child ; Mrs Mansell came the same afternoon and apologised, saying it was done iii the f heat of temper and she couldn't control Jberself ; I refused to accept the apolpgyp Waiiter l^^seU was convicted, and &sheSad'alre^Sdy s been punished by th« schoolmaster, was dismissed with a caution.
Mrs Martha Mansell was convicted and; fined £s, cpst»tlßs, witnesses* expenses'lss, and- ordered" to find one surety of £25 to keep the peace for six months, the expenses to be paid at bnee, the fine in three mohthly instal-
ments.
Several for old age pensions were made and evidence taken, but none were granted.
