UNSUCCESSFUL CLAIM

CROSSING FATALITY SEQUEL

The hearing of a claim against the Crown for £550 damages, brought by the husband and daughter of a woman killed on a railway crossing, was concluded before Mr. Justice Callan and a jury. The victim of the accident was Mrs. Hilda Evans Fenton, who was killed at the Lloyd Avenue pedestrian crossing, Mount Albert, on December 1 last year.

The claim was made by Petition of Right, the suppliants being Wallace Wood Fenton and Mrs. Edna Mabel Mould, who were represented by Mr. F. C. Jordan.

After a retirement of three hours, the jury brought in a verdict for the Crown. They could not find any direct evidence against the driver of the train and it was the only verdict they could give, said the foreman. Judgment was entered accordingly with costs.
