MARKING ON FRUIT CASES MAGISTRATE TO DECIDE (P.A.) HASTINGS, Wednesday. A case of interest to orchardists was heard in the Magistrate's Court yesterday, when the question arose as to whether the count number shown on a case indicated the number of apples or the grade of fruit. The hearing arose out of two informations preferred by the orchard inspector against Edward Malcolm Langley, of wrongfully numbering two cases of fruit which were ready for dispatch ,to customers. The informant said that one of the cases branded 138 count contained only 77 apples, and the other, an 113 count, contained S3. In each case the count number was plainly stamped on the outside. Under the regulations the cases should have contained the quantity of fruit according to the count numbering. Counsel for the defence held that the count did not represent the number of apples in the case, but the size of the apples. Many orchardists were under the impression that the count indicated the size and not the number. The magistrate. Mr. J. Miller, reserved his decision.
