SEQUEL TO AUCTION

NO RIGHT OF APPEAL An unusual appeal before the Land Sales Court yesterday was that of a purchaser at an auction sale. A section of 2 acres 21 poles on Flat Bush Road, near Papatoetoe, had been sold at auction under a Supreme Court order for non-payment of rates, and Joseph A. Eccles bought it for £165, at which price the North Auckland Land Sales Court approved the sale. The vendor appealed on the ground that the auction price was not justified, in view of the fact that in the valuation roll of the Manukau County Council for 1938 the property was valued at £70.

The Court held that the purchaser, having bid at the auction and been a party to the application to the committee for approval of the sale, had no right of appeal.
