JURY AWARDS £2750
AGAINST HARBOUR BOARD
The action in which Mrs. Barbara Elizabeth Barnes (Mr. North and Mr. Simpson) claimed £4029 compensation against the Auckland Harbour Board (Mr. Hamer) and Booth, Macdonald and Co., Ltd. (Mr. Cocker and Mr. Goldstine), was concluded before Mr. Justice Callan and a jury yesterday, when the jury found in favour of plaintiff as against the Harbour Board.
Arising out of the death by accident of plaintiff's husband, a permanent employee of the Harbour Board, when he was engaged driving one of the board's mobile cranes to shift a cargo consignment on behalf of Booth, Macdonald and Co., the case involved the issue of who was the man's employer at the time of the accident.
After a retirement of four hours the jury returned replies to the issues finding negligence on the part of the Hai'bour Board and assessing damages at £2750 and £29 funeral expenses. Mr. Hamer was allowed 14 days in which to move for a new trial.
