MOTOR CYCLIST ACQUITTED
Arising out of an accident in t nke Koad, Takapuna. on Febru i", when a man aged 76 years' was knocked down by a motor cvcle nPvvon 7 ? onald , Je ssen, butcher, of \\ ells ford aged 21 years, Jessen (Mi. Ackmsj was charged before Mr. Justice Callan and a jury in the Supreme Court with negligent driving caused death, or alternatively causing bodily injury. The man knocked down. Mr. N Veale hari a leg broken below the knee, and while in hospital died of a heart trouble. dU
Evidence showed that the motor cyclist was on his correct side of the road and riding at a moderate pace with the result that the cvcle was brought to a halt almost immediately the collision occurred, 36ft out from the footpath. The Crown relied on the accused's statement that he did not see the pedestian until within a few vards lookout aS in ' iicating lack <)f Proper After a retirement of two hours the jury returned a verdict of "not guilty, and aceilsed was discharged.
