BUSH ROAD ACCIDENT

HEAVY DAMAGES CLAIM The claim arising out of a bush road accident at Kauri, near Whangarei, in which Lionel C. Davies, foreman driver (Mr. Trimmer and Mr. McCarthy), sued Dave Hill and Sons, Ltd., contractors, Whangarei (Mr. North and Mr. L. Johnson), for £119 special and £2500 general damages, was resumed in the Supreme Court to-day before Mr. Justice Fair and a jury. The claim was made on the ground that the accident was occasioned by the negligence in driving of Fred Hill, by whom plaintiff was employed. In defence, it was claimed that the accident arose out of the nature of the road, and that plaintiff voluntarily accepted whatever risks were involved in accompanying Hill in a truck over the road. At the worst, it was claimed, that the accident arose from an error of judgment in driving at a difficult place. (Proceeding).
