SEQUEL TO ACCIDENT.
DRIVER NOT INTOXICATED.
In \ icw of the certificate jriven bv a doctor, Mr. J. Morlin«. S.M., in "the Police Court to-dav, dismissed a charge brought against Daniel McKennev. "a motor driver, ajred 40. McKenncv. for whom Mr. Ackins ap peared, pleaded not guilty to a charge of being in a state of intoxication while in charge of a motor truck in Carlton tiore Road on January 10.
Counsel said McKcnnov was at present serving a sentence of three months' ; m prjsonmcnt imposed on February 27. for negligent driving so as to cause actual bodily harm. Accused pave evidence denying that he was intoxicated at the time of an accident in Synionds Street. Mr. Aekins produced a certificate -riven by Dr. A. H. McDougal] to the police, the doctor stating that as a result of hi* examination of McKenner half an hour after MeKe-«ncy\« arrest' he found no evidence of alcoholic intoxication to a decree rendering him unfit to be in cliarpe of a motor vehicle. The magistrate remarked that \|.- Keimeys physical dejects would no noiibt mislead anybody as to hi* oi: dition <»t sobriety. The charge ua* t ]i» missed.
