LEGAL INQUIRY COLUMN.
(By BARRISTER-AT-LAW.) [Letters of inquiry will be answered erery week in this column. As far as possible they will be dealt with in the order In which they are received and replies will be inserted with the least possible delay.] ' PINE STREET.—Your letter does not suggest that you have a remedy against anyone. The council has a map fixing street levels as they are or are intended to be. Unless the level originally fixed and shown on the map has been altered since you built, you are not entitled to any compensation. The builder presumably had no choice but to build In accordance with the plans, and if he has built the floor at the height shown above ground level he has done all be contracted to do. The person preparing the plans may be responsible if he drew them without reference to the permanent street level. URGENT.—For a breach of the Dairy Industry Act a maximum fine of £50 is prescribed. It is. of course, possible that two or three offences have been committed, and it would be open to the prosecution to prosecute for each offence. MAINTENANCE.—Your creditor is not obliged to accept payment by instalments. He is likely to do so only if he thinks that proceedings will not result in payment any faster. If you are able to pay all you will be wise to do so. because if proceedings are taken you wIU have costs added to the debt. If you are genuinely unable to pay except by instalments, write to the creditor Informing him of your financial position and offer to pay by instalments of an amount that you can manage. MORTGAGOR.—Leave of the Court Is required before the property can be sold by the mortgagee. You will have notice of hit application for leave. Meantime Day what you can.
