motion for new trial. A motion bv the New Zealand Railway Department (Mr. N. I. Smith) for a mew trial of the claim against the Department by Mrs. Evelyn Maud Poole (Mr. A. H. Johnstone, K.C.), who was awarded damages by a jury in a hearing last session, was heard in the Supreme Court to-day by Mr. Justice Johnston. After having heard argument by counsel his Honor held that there was evidence of negligence put before the jury and though he might not have reached the same conclusion as the jury he must dismiss the motion for a new trial, or nonsuit, or for a verdict in favour of the Crown. Fifteen guineas costs were allowed suppliant on the motion.
