THEFT ALLEGED.
FETTLER BEFORE COURT.
COMMITTED FOR TRIAL. ~ - f Pleading not guilty to the theft of a- canteen, gramophone, towel, suppercloth and nine curtains, of a total value of £21 12/0, David Joseph McCarthy, fettler, aged 28, appeared before two Justices in the Police' Court to-day and was . committed-to the Supreme Court for trial. Detective-Sergeant McHugh prosecuted, Mr. J. F. W. Dickson appearing for the accused.
Evidence was given by Mrs. Christina O'Connor and a daughter that the articles produced in Court had been in 'their home at St. Helier's on February 5. 1937. when the house was locked up. They returned on April 18, and found the' articles missing. Trethewey said he interviewed the accused at the letter's home in Duke Street, Mount Roskill, and recovered the goods alleged to have been stolen from the house of Mr?. O'Connor. Accused etated that when he got married in March, 1937, the articles were given him as wedding presents by an uncle in Stratford.
The uncle gave evidence denying that he had given the accused any wedding presents. Bail was fixed at £100.
On a charge of stealing two spanners and two wood chisels valued at £1, the property of the New Zealand Government, the accused pleaded not guilty. Accused stated that when employed at the Otahuhu railway workshops, he found the tools lying in the grass. They were rusty, and he cleaned them and took them home. He admitted that he had no authority to take them. Accused wae convicted and fined £5, in default 14 days' imprisonment.
