COURT DISMISSES MOTION.
Dismissing a motion for rc-trial brought I>.v Ronald George Orr. motor driver (Mr. West), against William Ancel Reynolds, labourer, of St. Heliers (Mr. 'lonian) in the Supreme Court yesterday. Mr. Justice Fair upheld a jury's damages award of £')')! and made judgment accord'ngi v.
Petitioner in the original action, Reynolds, -.laimed damages from Orr following a motor cycle accident in Remuera Road, near the corner of Ngapuhi Road, on February 22, 1938. Petitioner was riding a motor cycle and sidecar, and defendant was driving a van. Though the vehicles did _ not actually come into collision, petitioner claimed that injuries he received were due to defendant's negligence. His right knee cap was fractured, and had later ii be removed. !lv: Honor said he did not think that ' r jury had acted in an unreasonable u l ." 11 iier or that its conclusions were such no jury could have reasonably arrived .it. He therefore dismissed the motion, with £10 10/ coats to plaintiff. Judgment would be for plaintiff for £557, with costs, witnesses' expenses and disbursements.
