WHANGAREI CASE.

THE JURY'S VERDICT. EFFECT TO BE ARCUED. In the claim heard in the Supreme Court yesterday before Mr. Justice Fair and a jury in which (Jeorge Brott, labourer, of Onerahi (Mr. Leary), claimed £!>75 damages from Robert Harold Allan, signwriter, of Whangarei, in consequence of injuries received when he was struck by defendant'* motor car as he was walking across Bank Street, Whangarei, the jury found that both parties were guilty of negligence, but that defendant had had last opportunity of exercising reasonable care by which an accident might have been averted. They assessed damages for plaintiff at £375 general and £252 8/fi special. Mr. Leary moved for judgment, and Mr. Trimmer (for defendant) moved that judgment be not entered pending argument on the effect of the verdict and on a nonsuit point raised earlier in the hearing by his senior counsel, Mr. Xorth. He applied for 14 days in which to move for judgment or for a new trial. His Honor granted the extension of time applied for, and reserved for further argument the motions for judgmest, for nonsuit and.-far a new trial.
