WRONG CLAUSE.
CHINESE ESCAPES CONVICTION i CONDEMNED FRUIT EATEN. A charge against Willie Wong,, a Chinese gardener at Mangere, was dismissed this morning when he was charged at the Onehunga Police Court, before Mr. C. R. Orr Walker, S.M., with failing to abate a nuisance. The inspector for the Manukau County Council, who prosecuted under the Health Act, said that Willie Wong bought some condemned oranges at the f itj Market to be used as manure for his land at Manure. He allowed the fruit to remain on the ground for some time, and Maori children were found eating the best part of some of the oranges. The charge was laid under clause 2G of the Health Act. The magistrate ruled that defendant should have been charged under clause with causing a nuisance, rather than with failing to abate one, and dismissed the case.
